Host Agreement
v1.0 · 2026-08-23
This Host Agreement (the "Agreement") governs the use of the Zonbook platform by any individual or entity that lists accommodation on it (the "Host"). By creating a host organisation or publishing a listing, the Host accepts this Agreement and the documents incorporated by reference in clause 2.
Zonbook acts as an online intermediation service within the meaning of Regulation (EU) 2019/1150 (P2B). Zonbook neither owns, leases nor operates the accommodation, and is not a party to the accommodation contract between Host and guest.
1. Parties
Platform operator: Artem Zon
Address: Gran Alacant, Santa Pola, Alicante, España
Address for notices: [email protected]
Zonbook is a trading name under which the individual named above operates. The intermediation contract is entered into directly with that person, who owes the Host the obligations this Agreement attributes to Zonbook.
The Host is the organisation identified in the host portal together with the users it grants access to (owner, manager, staff and cleaning roles). The Host is responsible for their acts and omissions.
2. Incorporated documents
The following form an integral part of this Agreement:
the Service Policy (acceptable use, content, conduct, suspension and complaints);
the Terms & Conditions, the Privacy Policy and the Legal Notice.
In the event of conflict this Agreement prevails, except on the matters each addendum specifically governs.
3. Eligibility
Be of legal age and have capacity to contract.
Hold sufficient title to the accommodation (ownership, usufruct, a lease permitting tourist sub-letting, or express authority from the owner).
Where regional law requires it, hold a valid tourist registration number and display it on the listing. The Host warrants the licence is in force and will report any suspension or revocation immediately.
Complete identity verification and, where applicable, the payout-account verification required by the payment provider.
Zonbook may request documentary evidence of the above at any time and unpublish listings for which it is not provided.
4. Listings and content
The Host is solely responsible for the accuracy of the listing: description, location, occupancy, amenities, photographs, prices, applicable taxes and licence number.
Photographs must depict the actual, current accommodation. The Host warrants it holds the necessary rights and grants Zonbook a non-exclusive, worldwide, royalty-free, transferable licence to reproduce, reformat and publicly communicate that content in order to operate and promote the platform, including via search engines, social media and partner channels.
As to content already distributed to third-party channels, that licence survives for the period reasonably needed to withdraw it after the listing is removed.
Listings must not contain direct contact details, external booking links or instructions to transact off-platform (see clause 8).
5. Pricing, availability and calendar
The Host sets its own prices. Zonbook imposes no price or availability parity with other channels.
The Host keeps its calendar current. Where external calendars are synchronised (iCal or other channels), the Host is responsible for that synchronisation working and for double-bookings caused by its failure.
The price shown to the guest is binding. The Host may not require amounts from the guest beyond those published in the listing, other than deposits, tourist taxes or supplements expressly stated in it.
6. Bookings and the guest relationship
Each confirmed booking forms an accommodation contract directly between Host and guest. Zonbook facilitates, documents and collects payment for it, but is not a party to it.
The Host must provide the accommodation as advertised, respond to guest messages through the platform's messaging, and provide access as agreed.
The Host will complete traveller registration and reporting to the authorities under Royal Decree 933/2021 and other applicable rules, using the data the platform collects for that purpose.
7. Commission, collection and payouts
Zonbook's commission is deducted from the amount paid by the guest and the remainder is paid out to the Host. The rate in force, charge timing, payout schedule and tax treatment are set out in the Fees and Payouts Schedule, which displays the rate the platform actually applies at any given time.
8. Off-platform bookings
The Host will not divert guests who made contact through Zonbook to book elsewhere, nor solicit payment outside the platform for such bookings. This obligation protects payment traceability, cancellation-policy cover and traveller registration; breach entitles Zonbook to claim the avoided commission and to apply the measures in clause 11.
Nothing above prevents the Host from marketing the same accommodation through other channels or directly to guests it sources itself.
9. Host cancellations
Guest cancellations are governed by the Cancellation Policy. Where the Host cancels without demonstrated force majeure, the guest is refunded in full and Zonbook may, proportionately and on notice: block the affected dates, pass on the direct cost of rehousing the guest, reduce the listing's visibility, or suspend it where the conduct is repeated.
10. The Host's legal and tax obligations
Obtain and maintain any required licences, tax registrations and insurance; comply with regional tourism rules and applicable municipal by-laws.
Declare and pay its own taxes (VAT or IGIC, personal or corporate income tax, tourist taxes). Zonbook may be required to report tourist lettings to the tax authorities; the Host will supply the data needed and is responsible for its accuracy.
Comply with data-protection law as regards guest and traveller data on the terms of the Data Processing Addendum.
11. Restriction, suspension and termination
Zonbook may restrict, suspend or terminate the service to the Host in the cases and with the safeguards set out in the Service Policy, which contains the statement of reasons, notice period and internal complaint-handling procedure required by Regulation (EU) 2019/1150.
The Host may terminate this Agreement at any time by removing its listings. Termination does not affect bookings already confirmed, which must be honoured or cancelled under clause 9, nor commission already earned.
12. Liability
Zonbook is responsible for the availability and proper functioning of the platform to the standard of care required of it, without guaranteeing any volume of bookings, level of income or particular position in search results.
The Host will indemnify Zonbook against claims by guests, third parties or authorities arising from the accommodation, from the absence of a licence, from an inaccurate listing or from breach of the Host's legal obligations.
Nothing limits liability for wilful misconduct, gross negligence, personal injury, or any other liability that mandatory law does not permit to be excluded.
13. Changes
Zonbook will notify any change to this Agreement on a durable medium at least 15 days before it takes effect, or such longer period as is reasonably needed where the change requires technical or commercial adaptation. The Host may terminate free of charge before that date; publishing new listings or accepting new bookings after it constitutes acceptance. No notice period applies where the change is imposed by a legal obligation or responds to an imminent security or fraud risk.
14. Governing law and jurisdiction
This Agreement is governed by Spanish law. The parties submit any dispute to the courts of the platform operator's domicile, unless mandatory law provides otherwise — in particular the consumer's forum where that applies. Before going to court the parties will attempt resolution through the internal complaint-handling procedure and the mediation provided for in the Service Policy.
